Do you need a lawyer who knows brain injury?

Why a lawyer with experience handling brain injury cases can make a difference.

Traumatic brain injury (TBI) cases are medically, legally, and emotionally different from other injury claims. Brain injuries are often described as invisible injuries because the person injured may appear normal despite suffering from cognitive, emotional, and physical consequences such as:

  • Memory and concentration problems
  • Visual problems
  • Dizziness and balance problems
  • Headaches
  • Behavioral changes such as loss of motivation, inappropriate emotional responses, and anger outbursts
  • Anxiety and depression
  • Fatigue
  • Inability to finish tasks, particularly if they involve multiple steps
  • Loss of the ability to plan or solve problems

Persons with traumatic brain injuries and their caregivers require significant emotional support that lawyers who represent clients with brain injuries are used to providing.

Current studies suggest that emergency rooms fail to diagnose about half of all patients with traumatic brain injury. Primary care physicians also often miss the diagnosis although not at the same rate as emergency rooms. Initial radiology imaging is likely to be normal in large part because most imaging protocols show brain injury only when the injury is severe. These facts mean it is important for a person with a brain injury to get to doctors who can diagnose their condition and treat it. Many times helping  persons with a brain injury find these medical specialists is even more important than any monetary recovery. Lawyers who regularly represent people with brain injuries are best positioned to provide this advice.
While the most common cause of brain injuries are car crashes, other causes include slip and falls, construction accidents, and pedestrians or bikers hit by cars or truck.

Even a person with a "mild" traumatic brain injury or concussion can have consequences that linger for the rest of the person's life. They deserve a lawyer who knows how to represent them.
